Terms & Conditions
These terms and conditions ("Terms”) help to keep the CheekyBucketWeb site a secure place to trade and set out the full extent of any agreement reached between you and CheekyBucket. On placing an order, you agree to accept the following terms and conditions:
1/. The owner of the website is CheekyBucket ABN: 34 229 637 564 and the contract for purchases made through website is with CheekyBucket.
2/. You agree to email being used as the primary means of communication.
3/. No contract for the sale of any product will subsist between you and CheekyBucket unless and until CheekyBucket accepts your order by way of an e-mail via the Paypal gateway confirming that it has received payment in full for all the goods you have ordered. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time CheekyBucket and or PayPal sends the e-mail to you (whether or not you receive that e-mail). This confirmation e-mail amounts to an acceptance by CheekyBucket of your offer to buy goods from CheekyBucket.
4/. It is the responsibility of the purchaser to check that the details on the confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it. It is your responsibility to notify us immediately if any details provided are incorrect or if the details change. No responsibility will be accepted by CheekyBucket to recover or re-send goods sent if details at the time of placing the order were entered incorrectly or if details change post placing the order and it’s subsequent processing.
5/. All prices include GST (where applicable), and no charge is made for postage within Australia. International shipping charges apply. Every purchase you make shall be deemed performed in Australia. Australian law shall govern every aspect of contractual agreement concerning purchases made from the Web site.
6/. No financial information is stored on the CheekyBucket website. All payments are made using the PayPal website via a PayPal account or credit/debit cards. You undertake that all details you provide to CheekyBucket via PayPal for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.
7/. All purchases are non-exchangeable, non-refundable and non-transferable unless otherwise stated. CheekyBucket reserves the right to change information, prices and descriptions of listed goods, products and services at any time.
8/. In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order CheekyBucket shall make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question PROVIDED THAT you notify CheekyBucket of the problem in writing at the address stated in the confirmation e-mail within 7 working days of delivery of the goods. This clause doe not affect your statutory rights.
9/. CheekyBucket bears no responsibility for goods that might become damaged once opened by the purchaser. Goods are made from canvas and mdf board and will respond poorly to rough treatment, water spillages and general poor care. Goods have been heat sealed for added protection and are deigned to stay vibrant and bright for 3-5 years. Like any printed goods they might fade if left in direct sunlight for extended periods.
10/. The products sold on the Web site are provided for private domestic and consumer use only. Any commercial trading of these products should be with the express permission of CheekyBucket and the necessary commercial trading agreement between the two parties involved. Please see copyright.
11/. It is the recipients responsibility to ensure the painting is hung safely and securely. CheekyBucket accepts no responsibility for any accidents that may occur during the hanging process or once paintings have been displayed.
11/. CheekyBucket aims to dispatch goods within 3 working days. The period of delivery are approximate and are as stated on the Postage Sidebar on each ordering page. CheekyBucket shall have no liability to you for any delay in the delivery of products ordered to the extent that the delay is due to any event outside our reasonable control. If choosing Air Mail you are aware that items will be left at your door or as otherwise stated at your own risk. CheekyBucket bears no responsibility for items once left for the purchaser at the subject address.
13/. If your delivery address is outside of Australia, you may be subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by you. You should note that customs policies vary widely from country to country; CheekyBucket advises each customer to contact their local customs office for further information. Please note that when shipping products internationally, cross-border shipment are subject to opening and inspection by customs authorities.
14/. Subject to the license granted to you to use the Web site, CheekyBucket reserves all rights, title and interest in its Intellectual Property Rights in the Web site. In these Terms, “Intellectual Property Rights” means copyright, design rights (whether registered or unregistered), trademarks (whether registered or unregistered) and other similar rights, together with the right to apply for the protection of any such rights. We shall own all Intellectual Property Rights in the Web site absolutely.
